    Rob Kleeger has been asked to return in May to speak to The Joseph Halpern-David Furman American Inns of Court. The presentation is entitled: “10 Things Attorneys Should Know About Digital Forensics, eDiscovery, the Cloud, and Cyber Security"

    Brief Overview:

    It is a fact of modern life that an enormous volume of information is created, exchanged, and stored electronically in our business and personal lives.  More commonly, a majority of legal cases involve a digital aspect that, if properly uncovered and examined, digital evidence an help build stronger cases and occasionally to force settlements.  Recovering a particular email, a deleted memo, or the date and time a web page was printed can be critical to a legal matter.  More often than not, discovering when, how, and who created the digital information can be equally important and perhaps the smoking gun.  In other instances finding hidden or deleted financial information on a computer is the key to a strong case.  
     
    Alternatively, very law firm is vulnerable to cyber security breaches, just like virtually any other business today. However, law firms are particularly attractive targets for hackers. At the same time, law firms are subject to not only the laws that apply to any other businesses, but to legal ethics rules as well.

    Guest Lecturer for Seton Hall Law School

    Rob Kleeger will be providing a lecture on Digital Forensic Investigations and eDiscovery to Seton Hall Law School.  In addition, the following week, he will be participating in a simulated Rule 16 Meet and Confer session.

    The first portion of the class will be Rob Kleeger playing the role of an IT director for a Defendant in a contract breach claim.  His role then will shift to be the role of a highly compensated CIO who plays the corporate politics game extremely well, yet doesn’t really know much about technology other than throwing around buzzwords and techie acronyms. 

    The students use probing questions to determine what the respective Plaintiff and Defendant’s IT Data Map looks like in order to properly identify, preserve, and prepare for a meet and confer conference in the upcoming weeks.

    What you don't know about the DFS-Department of Financial Services regulations CAN HURT YOU!

    Cyber and information security is a growing concern for both lawyers and clients. Recently, the New York Department of Financial Services has proposed comprehensive “first in the nation” cybersecurity regulations that is proposed to take effect January 1, 2017. 

    These regulations will apply not only to all businesses regulated by the NYDFS, but also their outside counsel and other vendors...even if you are located in New Jersey.  

    This 3 hour CLE will be broken into two sessions. We will begin with a discussion and analysis of the legal and practical implications of the new NYDFS regulations and their potential impact on outside counsel, including how the regulations intersect and differ from the confidentiality requirements of the Rules of Professional Conduct regardless of if you practice in NJ,NY, PA, or elsewhere.

    In the second half of the presentation, using the NYDFS regulations as a framework, the panel will walk through a mock-scenario of a ransomware attack on a law firm’s information systems. This discussion will cover the technical, liability, and insurance coverage issues that may arise as a result of this and similar cybersecurity events. 

    We also will integrate the RPC and how the rules being changed regards to attorneys ethical obligation to understand technology, confidentiality, and cyber awareness.

      Rob Kleeger and CFO Studio welcome Dave Weinstein to the Cyber Security Panel.

      On May 5, 2016, The CFO Innovation Conference at Met Life Stadium, will be hosting a Full Day Event.  Between 300 and 500 CFOs from New Jersey, New York, Connecticut, and Pennsylvania are expected.  

      Dave Weinstein is the Director of Cybersecurity for NJOHSP and the Chief Information Security Officer (CISO) for the State of New Jersey. Mr. Weinstein joined NJOHSP in August 2014.

      Prior to joining NJOHSP, Mr. Weinstein served at the United States Cyber Command in Fort Meade, Maryland, where his portfolio spanned cybersecurity operations, policy, and planning. Following his time with the Defense Department, he joined the private sector where he consulted commercial clients on managing their cyber risk.  

      Mr. Weinstein has been recognized by Forbes magazine as a “top cyber policy expert” and his analysis and commentary have been featured in numerous media and academic publications, including The Christian Science Monitor, the Georgetown Journal of International Affairs, the US Naval Institute’s Proceedings, Foreign Affairs, Foreign Policy, CNN.com, and The Boston Globe.

      Rob Kleeger is the Founder and Managing Director of Digital4nx Group, Ltd.  His firm provides Digital Forensic Investigations, Electronic Discovery Consulting and Advisory Service, Incident Response to Data Breaches and Cyber Security services such as “Ethical Hacking”.
