Susan Marcison was a Vice President of Sales for Northern Sun Resorts New York, NY location. She was with the company for over four years and was a top producer for the past three. On January, 2014, she entered the office of HR director, Liza Hayes and handed over a document to stipulating that the CEO of Northern Sun Resorts had been sexually harassing her for the past 6 months.
Marcison explained that she made regular entries into this document creating a “journal like record” of all the encounters. She further stated that the prior night’s New Year’s party was fraught with sexual advancements from the CEO.
Ms. Hayes documented all of Marcison’s allegations and immediately started an internal investigation. Liza Hayes interviewed CEO Jack Evans, who denied all allegations. After weeks of fruitless internal investigations, she contacted Digital4nx Group to see if digital forensics could “crack the case”.
Digital4nx Group’s forensic analysts arrived onsite to perform an analysis of Marcison and Evans respective PCs. Due to the nature of this project, the forensic analysts were dressed as a cleaning crew to avoid calling attention to themselves. The team created forensic images of both systems, and returned the PCs and surrounding areas to their “original state” to avoid raising suspicion.
Four days later, we contacted Ms. Hayes to report our findings. The evaluation of Jack Evan’s PC identified nothing of evidentiary value. The evaluation of Ms. Marcison’s PC, however, identified that she had performed substantial research on sexual harassment and monetary compensation received from sexual harassment law suits. Her research was conducted from 12/15/12 to 12/18/13.
Additionally, the document that she provided to Ms. Hayes as “journal” of the activities was extracted and analyzed by us. The evaluation of the document determined that it was not a compilation of entries over 6 months of time, but instead prepared over about an hour of time on the morning of 01/02/14.
Susan Marcison was terminated and had dropped all suits against Northern Sun Resorts. Northern Sun Resorts avoided a costly litigation and the CEO maintained his reputation and integrity.
